In those cases in which we buy used homes from the owner, the tax to pay will not be the Value Added Tax (VAT), but the Property Transfer Tax, which is paid to the Autonomous Community in which the company is located. Acquired home, by means of the self-assessment of its amount in an official form, and deposit of that in an account of the Public Treasury through any of the collaborating banking entities. Amount: its amount is set by applying the 10% tax rate (the competent Autonomous Community may have established a different tax rate) on the value declared in the public deed. In addition, in those municipalities where it is required, it will be subject to the payment of the Capital Gain, that is, to the payment of the Tax for the increase in the value of urban land whose collection corresponds to the City Council where the house is located and whose payment corresponds to the seller . For the purposes of obtaining the registration in the Property Registry, it will be enough to prove that the sale has been communicated to the corresponding City Council.
In almost all the Autonomous Communities, there are also reduced rates for VPO, public protection housing, purchase of habitual residence, purchase by minors aged 35-36 years.
