HOW TO BUY A HOUSE IN SPAIN
1st May 2021WHO MANAGES THE REGISTRATION?
In order for the property right to be registered in the Property Registry, it is necessary to present it at the Registry Office in whose territory the acquired home is located.
Authorized copy of the public deed of sale.
Tax self-assessment form from which it appears that the self-assessment amount has been paid.
Accreditation of the communication of the transmission to the corresponding City Council.
Last receipt of the IBI, in order to be able to record the property's cadastral reference in the Registry.
Submission of such documents can be done.
Directly by the buyer
By an agency.
By the Notary if it provides management services.
In any case, it is necessary to know that once the document has been presented in the Registry, the registration will have to be carried out within the following fifteen business days. The Registrar will verify that the contract is entered into with all the requirements established by law so that it is fully effective and the buyer's property right can access the Registry, and if he understands that the document has a defect that prevents its registration (defects in the form , lack of capacity of the parties, lack of adaptation to the content of the Registry, etc.) will have to notify it reliably when presenting the document. This may correct the defects appreciated or, if it does not agree with the qualification of the Registrar, file an appeal with the General Directorate of Legal Security and Public Faith, or request a review of the qualification made by the Registrar that, according to a statutory approved box, must replace the one it qualified.
