What to do with hidden defects in new construction?
Yes, hidden defects can appear in new build houses and they can be claimed. “The actions that are exercised can be against the seller, developer, builder, technical management, project management, etc., that is, you can claim all the natural or legal persons involved”,
How long is there to claim?
“During ten years from the date of reception of the work, material damages caused in the building due to vices or defects that affect the foundation may be claimed. For example, supports, beams, floors, load-bearing walls or other structural elements, and that directly compromise the mechanical strength and stability of the building”
In addition, for three years after delivery, damages caused to the building due to hidden defects or defects in the construction elements or installations that cause non-compliance with habitability requirements may be claimed.
