THE RESOLUTION OF CONFLICTS BEFORE THE REGISTRAR
8th May 2021REAL ESTATE, NEXUS GROUP, INFORMA.
What is the Registry conciliation?
It is an extrajudicial conflict resolution procedure in which the parties voluntarily go to the registrar who acts as a neutral third party, helping them reach an agreement on their own.
When can reconciliation be used?
In conflicts in which the parties want to avoid the trial or put an end to it, but do not reach an agreement, either because they have exhausted the negotiation path or because the dialogue has been broken and they do not see a possible solution to it.
Before whom do you go to conciliation?
Before the registrars holding the registries where the properties or rights that are the subject of the controversy are registered or the mercantile registrars where the affected companies are registered, where appropriate.
What are the matters subject to conciliation?
Any real estate, urban or commercial matter regardless of whether it is acts or businesses that can be registered. As long as it concerns matters that the parties can freely dispose of.
