The courts launch a judicial lifeline to those taxpayers who want to rectify the Income statement once it has already been submitted and request the return of undue income, despite the fact that the Tax Agency usually opposes it. And it is that for the Treasury that the citizen wants to apply tax benefits in the IRPF for the transmission of a home is a tax option, while for the Courts it is a right. Thus, for example, the Regional Economic-Administrative Tribunal (TEAR) of Castilla - La Mancha allows rectifying the IRPF once the Income campaign has ended in order to enjoy the tax exemption for the purchase of habitual residence.
